1. What data do we process and for what purposes?

 

When visiting our website

When you visit our website, the servers of our hosting provider Magento Commerce Inc. (345 Park Ave, San Jose, California, 95110, USA) store every access in a log file for a maximum period of 12 months. The following data is collected and stored by us until automated deletion:

  • the IP address of the requesting computer

  • the date and time of access

  • the name and URL of the retrieved file

  • the website from which the access was made, if applicable with the search word used

  • the operating system of your computer and the browser you are using (incl. type, version and language setting)

This data is processed for the purpose of enabling the use of our website, ensuring system security and stability on a permanent basis, and for error and performance analysis. It also enables us to optimize our website.

In the event of an attack on the network infrastructure of the website or suspicion of other unauthorized or abusive website use, the IP address and the other data will be evaluated for the purpose of clarification and defense and, if necessary, used in criminal proceedings for identification and civil and criminal action against the users concerned.

Our legitimate interest in data processing within the meaning of Art. 6 Para. 1 lit. f DSGVO lies in the purposes described above.

 

When contacting us through one of the offered options

If you contact us via our contact addresses and channels (e.g. by e-mail, telephone contact form, contacting customer service), your personal data will be processed. The data that you have provided to us is processed, e.g. your name, the name of your company, your e-mail address or telephone number and your request. In addition, the time of receipt of the request is documented. Mandatory data is marked accordingly in contact forms (e.g. with an asterisk).

We process this data exclusively in order to answer your inquiry in the best possible way. The legal basis for this data processing is our legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO in answering your inquiry or, if your inquiry is directed towards the conclusion or performance of a contract, the performance of the contract within the meaning of Art. 6 Para. 1 lit. b DSGVO.

For the provision of contact forms we use Typeform of Typerfom SL (C/Bac de Roda, 163, 08018 Barcelona, Spain). This allows us to provide you with an easy way to contact us. The legal basis for this processing is our legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO in the use of third-party services.

 

When opening a customer account

If you open a customer account on our website, we collect the following data, with mandatory data marked accordingly (e.g. with an asterisk):

We use the personal information to establish your identity and verify the requirements for registration. We store your data together with the marginal data of the order (e.g. time, order number, etc.), the data on the ordered/booked services (e.g. designation, price and characteristics of the product), the data on payment (e.g. selected payment method, confirmation of payment and time) as well as the information on the processing and fulfillment of the contract (e.g. return of products, use of service or warranty services, etc.) in our CRM database so that we can ensure correct order processing and contract fulfillment.

Insofar as this is necessary for the fulfillment of the contract, we will also pass on the required information to any third-party service providers (e.g. transport companies).

The legal basis for this data processing is the fulfillment of the contract with you according to Art. 6 para.1 lit. b DSGVO.

The provision of data that is not marked as mandatory is voluntary. We process this data in order to tailor our offer to your needs in the best possible way, to facilitate the processing of contracts, to contact you via an alternative communication channel if necessary with a view to fulfilling the contract, or for statistical collection and evaluation to optimize our offers. The legal basis for this data processing is your consent within the meaning of Art. 6 para. 1 lit. a DSGVO. You can revoke your consent at any time with effect for the future.

 

When paying on our website

If you purchase paid services or products on our website, depending on the product or service and the desired method of payment - in addition to the information mentioned in section 1.4 - the provision of further data is required, such as your credit card information or the login with your payment service provider. This information, as well as the fact that you have purchased a service from us for the amount and at the time in question, will be forwarded to the respective payment service providers (e.g. payment solution providers, credit card issuers and credit card acquirers). In order to avoid payment incidents, the necessary data, in particular your personal details, may also be transmitted to a credit agency for the automated assessment of your creditworthiness. In this context, the credit agency may assign you a so-called score value. This is an estimate of the future risk of non-payment, e.g. based on a percentage. The value is collected using mathematical-statistical methods and including data from the credit agency from other sources. We reserve the right, according to the information received, not to offer you the payment method "invoice". When registering for our newsletter

When you register for our e-mail newsletter, we collect the following data, with mandatory data marked accordingly (e.g. with an asterisk):

To avoid misuse and to ensure that the owner of an e-mail address has actually given their consent themselves, we rely on the double opt-in process for registration. After sending the registration, you will receive an e-mail from us, which contains a confirmation link. To definitely register for the newsletter, you must click on this link. If you do not click on the confirmation link within the specified period, your data will be deleted again and our newsletter will not be sent to the specified address.

The link to a customer account helps us to make the offers and content contained in the newsletter more relevant to you and better tailored to your potential needs.

We will use your data for emailing until you revoke your consent. Revocation is possible at any time via the unsubscribe link in all our marketing emails.

Our newsletters may contain a web beacon or 1x1 pixel (tracking pixel) or similar technical tools. A web beacon is an invisible graphic that is linked to the user ID of the respective newsletter subscriber. For each newsletter sent, we receive information about which addresses have not yet received the email, to which addresses it was sent and for which addresses the sending failed. It also shows which addresses have opened the email, for how long, and which links they have clicked on. Finally, we also receive information about which addresses have unsubscribed. We use this data for statistical purposes and to optimize the newsletter in terms of frequency, timing, structure and content of the e-mails. This allows us to better tailor the information and offers in our e-mails to the individual interests of the recipients.

We use the email marketing software Mailchimp from The Rocket Science Group, LLC (675 Ponce de Leon Ave NE Suite 5000. Atlanta, GA 30308, USA) for our newsletter and ensure the protection of your data by means of appropriate guarantees (usually the EU standard contractual clauses). Therefore, your data is stored in a database of Mailchimp, which allows them to access your data. The legal basis for this processing is our legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO in the use of third-party services.

 

When booking seminars or events

On our website as well as in our business premises you have the possibility to book seminars or events. For this purpose, we require your name and various other data for the processing of the contract. Depending on the seminar or event, we collect the following data, among others:

Insofar as this is necessary for the fulfillment of the contract, we will also pass on the required information to any third-party service providers (e.g. speakers). In addition, it may happen that you are referred to an external ticket platform for certain event bookings. In this case, please note the terms and conditions and privacy policy of the ticket platform.

When purchasing or ordering products in our business premises.

In our stores, you can usually purchase products without giving your name. Upon request, you will receive a receipt in paper form, which you should keep and present after the purchase in order to claim customer services. They also receive the information that the means of payment was used in our premises, the amount and the time of the transaction. Conversely, we only receive the credit for the amount of the payment made at the relevant time, which we can assign to the relevant document number, or information that the transaction was not possible or was cancelled. In our business premises, you can make use of numerous customer services for which the processing of personal data may be necessary. These include, for example, the collection of an ordered product, the return of products in exercise of a right of return, the complaint about a service etc. In such cases, we collect - depending on the product concerned or service requested, for example:

For actions and surveys

If you participate in a promotion we offer (e.g., a sweepstakes) or a survey (e.g., a customer satisfaction survey as part of market research), we may ask you to provide certain personal information. For example, in the case of a sweepstakes, we may ask you for your name and email address. In this way, we can notify you if you have won and ensure that each participant can only enter the prize once.

For some promotions and surveys, we also ask for more detailed information. This may be the case, for example, if we run a promotion with a partner and they need your data to offer you a prize. We use this data and other data voluntarily provided by you to review your application and to carry out the application process. Application documents of unsuccessful applicants will be deleted at the end of the application process, unless you explicitly agree to a longer retention period or we are not legally obliged to retain them for a longer period.

2. Where is the data stored centrally with us?

Insofar as a clear assignment to your person is possible, we will store and link the data described in this data protection declaration, i.e. in particular your personal details, your contacts, your contract data and your surfing behavior on our website in a central database. This serves the efficient management of customer data and allows us to adequately respond to your requests, and enables the efficient provision of the services you have requested and processing of the associated contracts. (225 Franklin St, Boston, MA 02110, USA) for this purpose and ensure the protection of your data by means of appropriate guarantees (usually the EU standard contractual clauses). The legal basis for this processing is our legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO in using the services of third-party providers.

We evaluate this data in order to further develop our offers in a needs-oriented manner and to display and suggest the most relevant information and offers to you. We also use methods that predict possible, interests and future orders based on your website usage. The legal basis for this processing is our legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO in the implementation of marketing measures.

4. What tracking, analysis and other tools do we use?

Google Analytics

We use the web analytics service Google Analytics from Google Ireland Limited (Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland) or Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) ("Google").

In the process, the data described in section 4.1 about the use of the website may be transmitted to Google's servers in the USA for the processing purposes explained. The IP address is shortened by activating the IP anonymization ("anonymizeIP") on this website before transmission within Switzerland, member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Google Tag Manager

On our website we use the Google Tag Manager from Google. Google Tag Manager is a solution that allows us marketers to manage website tags through one interface. The Tag Manager tool is a cookie-less domain and does not collect any personal data. The tool takes care of triggering other tags, which in turn collect personal data. Google Tag Manager does not access this data, according to Google. If a deactivation has been made at the domain or cookie level, this remains in place for all tracking tags that are implemented with Google Tag Manager. Google Dynamic Remarketing

Google Maps API

We use Google Maps API (Application Programming Interface, "Google Maps") from Google on our website, for the visual display of geographical information (maps). By using Google Maps, information about the use of our website, including your IP address, is transmitted to a Google server in the USA and stored there.

The integration of Google Maps enables us to visualize our location. This possibility forms our legitimate interest in processing within the meaning of Art. 6 (1) lit. f DSGVO.

It is possible to deactivate the Google Maps service and prevent data transfer to Google if you deactivate JavaScript in your browser. However, we would like to point out that in this case you will not be able to use the map display.

YouTube

On our website we integrate plugins of the video portal YouTube of YouTube LLC (901 Cherry Ave., San Bruno, CA 94066, USA) (YouTube). YouTube is a subsidiary of Google. Each time you visit a page that offers one or more YouTube video clips, a direct connection is established between your browser and a YouTube server in the USA. In the process, information about your visit and your IP address are stored. Through interactions with the YouTube plugins (e.g. clicking the start button), this information is also transmitted to YouTube and stored by YouTube. If you have a YouTube user account and do not want YouTube to collect data about you via this website and link it to your membership data stored with YouTube, you must log out of YouTube before visiting this website.

In addition, YouTube calls up the Google Analytics analysis tool (see section 4.2) via an iFrame in which the video is called up. This is YouTube's own tracking, to which we have no access. You can prevent tracking by Google Analytics by using the deactivation tools that Google offers for some browsers.

 

Criteo

On our website, we use the Criteo service of Criteo SA (32 Rue Blanche, 75009 Paris, France) ("Criteo").
